These terms govern your use of arksystems.ca. By using this website you accept them. If you do not accept them, please do not use the site.
ArkSystems is operated by FoodyGuru Inc., a company incorporated in British Columbia. In these terms, “ArkSystems”, “we” and “us” mean FoodyGuru Inc. operating as ArkSystems. “You” means the person or business using the site.
1. What this website is
This website describes what ArkSystems does and how we work. It is provided for information.
Nothing on this site is professional advice. We are not accountants, lawyers, tax advisers or auditors, we hold no professional designation, and nothing here should be relied on as advice about your own business, your finances, your tax position or your legal obligations. Decisions about your business remain yours, and where they require professional advice you should obtain it from a qualified professional.
2. No guarantee of outcome
We describe what AI systems do and what an engagement involves. We do not promise a particular result, a saving, a return, or a level of performance in your business, and nothing on this site should be read as such a promise.
Where an engagement is agreed, what we commit to is set out in the engagement agreement for that work, and only there.
3. Prices shown on this site
Any figure published on this site is a starting point, not a quotation and not an offer capable of acceptance.
“From CAD $1,000” and “from CAD $4,000” mean the minimum at which that kind of work begins. What a specific piece of work costs depends on its scope, and is quoted to you in writing after we understand what is involved. A price becomes binding only when it appears in a written agreement signed by both of us.
All figures are in Canadian dollars and exclude applicable taxes.
4. Booking a call
Booking a call through this site reserves time in a calendar. It creates no contract, no obligation on either of us, and no commitment to buy or to sell anything. Either of us may cancel or reschedule.
5. Our content
Everything on this site — text, images, illustrations, layout, the ArkSystems name, logo and tagline — belongs to ArkSystems or is used with permission, and is protected by copyright and trade-mark law.
You may read it, print it, and share links to it. You may not republish it, sell it, or use it as your own material, and you may not use the ArkSystems name, logo or tagline without our written permission.
Ownership of anything produced during a paid engagement — a workshop document, a specification, a built system — is dealt with in the engagement agreement, not here.
6. Acceptable use
Please do not:
- Use the site for anything unlawful
- Attempt to gain unauthorized access to the site or anything connected to it
- Interfere with the site’s operation or its availability to others
- Collect information from the site by automated means for commercial purposes, including scraping content or harvesting contact details for outreach
- Misrepresent yourself, or imply an association with ArkSystems that does not exist
7. Links to other sites
This site links to third-party services, including our booking provider. Following a link takes you to a service we do not control and that has its own terms and privacy practices. We are not responsible for those services or their content.
8. Availability
We aim to keep the site available and accurate, but we do not promise that it will be uninterrupted, error-free, or current at every moment. We may change, suspend or withdraw any part of it without notice.
9. Limitation of liability
To the fullest extent permitted by law, ArkSystems is not liable for any loss or damage arising from your use of this website, or from reliance on anything published on it, including lost profits, lost business, lost data or indirect or consequential loss.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, or rights you may have under applicable consumer protection legislation.
10. If these terms conflict with an agreement between us
If you are a client and we have a signed engagement agreement, statement of work or equivalent, that document governs the work and takes precedence over these terms wherever they differ. These terms cover your use of the website only.
11. Privacy
How we handle personal information is set out in our Privacy Policy, which forms part of these terms.
12. Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Any dispute is subject to the exclusive jurisdiction of the courts of British Columbia.
13. Changes to these terms
We may update these terms. The effective date at the top shows when they last changed, and the version in force is the one published when you use the site.
